Previously Unknown is a trading name of New Zealand Directory (2007) Limited ("we", "us", "our"). These terms apply to your use of our website, our apps, and our digital loyalty and wallet-pass services. By using them, you agree to these terms.
1. Our services
We provide:
- Software services — mobile apps, web applications, and custom software built for clients under separate engagement agreements.
- Digital loyalty services — stamp cards and passes delivered through Apple Wallet and Google Wallet on behalf of participating shops.
2. Loyalty cards and rewards
Loyalty cards, stamps, and rewards are offered by the participating shop, not by us. The shop decides what earns a stamp, what a reward is, and whether to honour, adjust, or expire cards. We provide the technology that records and displays them. Stamps and rewards have no cash value and are not transferable.
3. Fair use
You agree not to:
- Attempt to forge, duplicate, or manipulate stamps, passes, or QR codes.
- Interfere with, probe, or disrupt our services or infrastructure.
- Use our services for anything unlawful.
We may suspend cards or access where we reasonably suspect misuse or fraud.
4. Your information
Our privacy policy explains how we collect and handle personal information, in accordance with the Privacy Act 2020 (NZ).
5. Intellectual property
The software, design, and content of our services remain our property or that of our licensors. Shop names, logos, and branding shown on loyalty cards belong to the relevant shop.
6. Availability and changes
We work hard to keep our services reliable, but they are provided "as is" and we do not guarantee uninterrupted availability. We may update, change, or discontinue features, and may update these terms from time to time — the latest version will always be posted here with its effective date.
7. Liability
Nothing in these terms limits rights you may have under the Consumer Guarantees Act 1993 or other New Zealand law that cannot be excluded. Otherwise, to the maximum extent permitted by law, our liability arising out of or in connection with the services is limited to NZ$100, and we are not liable for indirect or consequential loss. If you use our services for business purposes, you agree the Consumer Guarantees Act 1993 does not apply.
8. Governing law
These terms are governed by the laws of New Zealand, and the New Zealand courts have exclusive jurisdiction.
